1. About these terms
These terms govern use of the Boreal website and Shopify app provided by UPILABS in Indonesia. “You” means the person using the service and, where you act for a business, that business. You must have authority to manage the relevant store and accept terms for that business.
By using Boreal, you agree to these terms. If you do not agree, do not use the service. Questions can be sent to yudha@upilabs.net.
2. What Boreal provides
Boreal provides tools to choose email themes, customize supported content and design settings, save projects, preview emails, send requested tests and export HTML and Liquid for Shopify Notifications.
Exporting or publishing in Boreal prepares code and the required assets. It does not automatically replace the notification code in your Shopify store. You are responsible for copying the output into the correct Shopify notification and saving it there. Shopify sends your store’s live notifications.
You should review and test each email before making it live, including links, images, wording, prices, translations and dynamic Liquid output. Appearance can differ between email clients, devices and Shopify notification contexts. A sample preview is not a guarantee of every live order’s output.
3. Your store and access
You must use a Shopify account and store you are authorized to access, keep account credentials secure, and use permissions appropriate to your role. You are responsible for the instructions and content submitted by people you authorize to use the app.
Do not share passwords, Shopify access tokens or other authentication secrets through email content, uploaded images or support messages. Tell us promptly if you suspect unauthorized use involving Boreal.
Shopify controls its own accounts, permissions, app installation and platform availability. Use of Shopify remains subject to your separate agreement with Shopify.
4. Your content and assets
You retain your rights in the logos, images, text and other content you provide. You are responsible for having permission to use it and for ensuring that the emails you create comply with applicable law, third-party rights and your commitments to customers.
You give us permission to host, copy, process, display and transmit your content only as needed to provide the requested service, including previews, saved projects, image preparation, test email delivery, exports and support. This does not transfer ownership of your content to us.
Boreal’s software, interface and pre-existing theme assets remain owned by us or their respective licensors. Subject to these terms and any applicable third-party license, you may use the generated email templates for stores you are authorized to manage. Your use of the service does not transfer ownership of the underlying app or pre-existing assets.
Email images can be made available through public URLs so recipients can load them. Do not place confidential information in those assets. Keep your own copies of important content and exported notification code.
5. Acceptable use
You must not use Boreal to:
- Send spam, phishing messages, malware, fraudulent content or unlawful communications.
- Upload content that infringes another person’s rights or disclose personal information without authority.
- Access another store’s projects, bypass permissions or usage limits, or interfere with the service’s security or availability.
- Use test email delivery as a bulk marketing or production sending service.
Send tests only to addresses you control or are authorized to contact. Feature and sending limits may apply to protect the service. We may restrict activity that violates these terms or creates a security or abuse risk.
6. Plans and billing
Available plans, included features and prices are shown in the app or its associated pricing page. The plan details shown when you approve a subscription govern its price, billing interval and renewal terms. A price displayed on the marketing website alone does not create a paid subscription.
Where paid billing is available, subscription approval and billing are handled through Shopify. Boreal does not collect your payment-card details. Taxes, currency conversion and billing adjustments may be determined by Shopify and the terms shown to you when you approve the charge.
You can manage app subscriptions through the relevant Shopify controls. Check Shopify’s displayed cancellation and billing information when changing a plan or uninstalling; stopping app use does not necessarily reverse a charge already incurred.
For billing questions or refund requests, contact yudha@upilabs.net. Requests are considered under the applicable plan terms and law. These terms do not promise a free trial, a refund period or an automatic refund, and do not limit any refund or consumer rights that cannot lawfully be excluded.
7. Privacy and third-party services
Our Privacy Policy describes the information processed by the app, public email assets, service providers and deletion requests. You are responsible for the lawful use of any personal information you choose to enter into project content or test emails.
The service depends on Shopify, hosting, image-storage and email-delivery services. Those providers may have their own terms and privacy policies. We cannot control third-party outages, platform changes, message filtering, recipient settings or whether a recipient loads an email image.
8. Ending use and data removal
You can stop using Boreal and uninstall the app through Shopify. We may suspend or end access where reasonably needed to address unlawful use, a material breach, security issues or a legal requirement. Where practical and appropriate, we will explain the restriction and how it can be addressed.
App-managed store data is removed through the deletion process described in the Privacy Policy, including Shopify’s store-data deletion request after uninstall. Uninstalling does not recall exported code, already-sent emails or files uploaded to Shopify Files. You manage those copies in the relevant service.
Keep any exports you need before ending use. Provisions that by their nature continue after use ends, including ownership, payment obligations already incurred and applicable legal rights, continue to apply.
9. Availability and responsibility
We aim to provide a useful, reliable service, but do not promise uninterrupted access, error-free output or identical rendering in every email client. Features may change as we maintain the app or respond to Shopify platform changes.
To the extent permitted by applicable law, the service is provided on an “as available” basis without additional implied warranties. You remain responsible for reviewing the emails you publish and for your store’s communications, customer policies and legal obligations.
Nothing in these terms excludes or limits responsibility for fraud, intentional misconduct, or any liability, statutory guarantee or other right that applicable law does not allow us to exclude or limit.
10. Changes, disputes and contact
We may update these terms and will identify the revised version using the date above. Material changes will be communicated as required by applicable law. If you do not agree to revised terms, you can stop using the service and manage any subscription through Shopify.
If a dispute arises, contact us first so we can try to resolve it. The laws of Indonesia govern these terms, subject to any mandatory rights and protections that apply where you live. These terms do not require you to waive rights that cannot lawfully be waived.
